Terms and Conditions of Sale

1. Scope

These general terms and conditions of sale (GTC) govern all orders placed on the jardinierquebec.com website by customers located in Canada.

They apply to any contract concluded between Julie Demers (Jardinier Quebec) and any individual or legal entity wishing to make a purchase via the website (hereinafter referred to as "Client").


2. Definitions

  • Seller: Julie Demers, a sole proprietorship registered in Quebec.
  • Client: any individual or legal entity aged 18 or over, acting for non-professional purposes, making a purchase on the website.
  • Products: horticultural products, seeds, gardening tools and accessories offered for sale on jardinierquebec.com
  • Parties: the Seller and the Client.
  • Contract: agreement formed upon validation of the order by the Client and confirmation by email from the Seller.

3. Products

The essential characteristics of each Product appear on the corresponding descriptive sheet: photos, dimensions, composition, price.

The Seller strives to ensure the accuracy of the information, but cannot guarantee the absence of errors or variations (colour, size) related to screen display or the nature of the plants themselves.


4. Prices

  1. Prices are indicated in Canadian dollars (CAD), all taxes included (GST and QST) or excluding taxes as indicated.
  2. Delivery charges are extra and detailed before checkout.
  3. The Seller reserves the right to adjust prices in the event of changes in tax rates or transportation costs; the price invoiced will be that in effect at the time the order is validated.

5. Orders and contract formation

  1. The Client selects the Products, indicates the delivery address and chooses the payment method.
  2. Before validating, the Client can check the contents of their cart and make changes.
  3. Validation of the order implies unreserved acceptance of these GTC.
  4. The Contract is concluded when the Seller sends the Client a confirmation email containing all the order information.

6. Payment methods

  • Credit card (Visa, Mastercard), Interac, PayPal.
  • Immediate payment upon order.
  • The Client's bank details are transmitted securely via the service provider's payment platform (Shopify Payments).

7. Delivery and transfer of risks

  1. Deliveries are made to the address indicated by the Client.
  2. Estimated delivery times are mentioned when ordering; these are average indicative times.
  3. The risks of loss or damage to the Products are transferred to the Client upon delivery of the goods to the carrier.

8. Right of withdrawal

In accordance with the Consumer Protection Act (Quebec), the Client has a right of withdrawal of 10 calendar days from delivery, without penalty or justification, with the exception of perishable or custom-made Products.

To exercise this right, the Client must send their request in writing (email or mail) before the end of the deadline and return the intact Products at their own expense, accompanied by the original invoice.


9. Warranties and liability

  • Legal conformity warranty: the Products sold conform to the description made by the Seller and are free of defects.
  • Warranty against hidden defects: applicable according to the Civil Code of Quebec.
  • The Seller's liability is limited to the amount of the order; it does not cover indirect damages.

10. Personal data

The Seller collects the data necessary for processing orders, administrative management and compliance with legal obligations.

This data is processed in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec's Law 25.

The Client has a right of access, rectification, deletion and portability: to exercise it, contact info@vertunjardin.com.


11. Intellectual property

All content on the site (texts, images, logos, graphics) is protected by the Copyright Act (R.S.C. 1985, c C-42). Any total or partial reproduction is prohibited without prior written authorization.


12. Anti-spam and electronic communications

In accordance with the Canadian Anti-Spam Legislation (CASL), any promotional message sent to the Client is preceded or accompanied by a free and easy-to-use unsubscribe mechanism.


13. Applicable law and dispute resolution

These GTC are subject to Quebec and Canadian law.

In the event of a dispute, the Parties will endeavour to find an amicable solution. Failing this, the courts of the judicial district of Quebec will have sole jurisdiction.
